1. AGREEMENT TO THESE TERMS

 

These Terms and Conditions ("Terms") govern your access to and use of the website located at https://www.mattbezci.com and any related pages, forms, tools, and communications we provide (together, the "Services"), which are operated by Pina Global LLC ("Company," "we," "us," or "our").

 

By accessing or using the Services, by submitting a form or questionnaire, or by opting in to receive communications from us, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree with these Terms, please do not use the Services.

Real estate brokerage services are provided by Matt Bezci, a New York State licensed real estate salesperson, through Compass, a licensed New York real estate brokerage located at 110 Fifth Avenue, Fourth Floor, New York, NY 10011. Pina Global LLC is not a licensed real estate brokerage.

 

3. ELIGIBILITY

 

You must be at least 18 years of age to use the Services or to opt in to receive communications from us. By using the Services, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms. We do not knowingly collect information from anyone under 18. See our Privacy Policy for more detail.

 

4. WHAT OUR SERVICES ARE, AND WHAT THEY ARE NOT

 

The Services provide general information about real estate in New York City and surrounding markets, including guides, market commentary, resource pages, calculators, and questionnaires that let you tell us about what you are looking for so that we can follow up with you.

 

The Services are informational. You cannot purchase anything, make a payment, place an order, or create a user account through the Services. Nothing on the Services constitutes an offer to sell or a solicitation of an offer to buy any property or security.

 

Submitting a form does not create a relationship. Completing a questionnaire, requesting a guide, or contacting us through the Services does not create an agency, brokerage, client, fiduciary, or other professional relationship between you and us. Any such relationship is created only by a separate written agreement signed by both parties.

 

Licensed brokerage services. Pina Global LLC operates this website and our marketing and communications. Pina Global LLC is not a licensed real estate brokerage. Real estate brokerage services referenced on the Services are provided by Matt Bezci, a New York State licensed real estate salesperson, through Compass, a licensed New York real estate brokerage, in accordance with applicable law. The Services are a marketing and information resource and are not themselves the provision of brokerage services. All real estate transactions are conducted through the brokerage.

 

5. NO PROFESSIONAL ADVICE

 

General information only. The content on the Services, including any guide, calculator, market report, analysis, or questionnaire result, is provided for general informational purposes only. It is not legal, tax, accounting, financial, investment, mortgage, appraisal, engineering, or architectural advice, and it should not be relied on as a substitute for advice from a qualified professional who is familiar with your specific circumstances.

 

No guarantee of outcomes. Any figure, estimate, projection, or comparison provided through the Services, including any rent versus buy analysis, valuation estimate, tax estimate, closing cost estimate, or market projection, is an estimate based on assumptions and on data believed to be reliable but not independently verified. Actual results will differ. Past market performance does not predict future results. We do not guarantee that any property will sell, rent, appreciate, or perform in any particular way.

 

Verify before you act. Property information, including availability, pricing, dimensions, square footage, taxes, maintenance and common charges, building financials, and permitted uses, is obtained from sources including owners, listing services, and public records. It is subject to errors, omissions, changes in price, prior sale, and withdrawal without notice. You should independently verify all information that matters to your decision, and you should retain your own attorney, accountant, inspector, and lender.

 

6. FAIR HOUSING

 

We are committed to the letter and the spirit of federal, New York State, and New York City fair housing laws. We do not discriminate, and we will not assist any person in discriminating, on the basis of race, color, religion, national origin, sex, sexual orientation, gender identity or expression, familial status, marital status, partnership status, disability, age, military status, lawful source of income, immigration or citizenship status, or any other characteristic protected by applicable law. We will not answer questions or provide guidance about the demographic composition of a neighborhood, school, or building.

 

7. INFORMATION YOU SUBMIT TO US

 

When you complete a questionnaire, request form, or calculator on the Services, you may choose to provide personal information, which can include financial details such as your budget, income, or financing status. Providing this information is always voluntary.

 

You agree that the information you submit is true, complete, and accurate to the best of your knowledge, and that you will update us if it changes. You agree not to submit information about another person unless you have that person's permission to do so.

 

How we handle the information you submit, including the limited circumstances in which financial information may need to be disclosed in connection with a transaction you are pursuing, is described in our Privacy Policy.

 

8. SMS AND TEXT MESSAGING PROGRAM

 

This section describes the terms of our text messaging program. It applies in addition to, and does not replace, the rest of these Terms.

 

Program description

 

The program is operated by Pina Global LLC. If you opt in, you may receive text messages from us relating to your inquiry and your real estate search. These may include replies to questions you have asked, appointment and showing confirmations and reminders, property and listing information you have requested, updates about a transaction you are involved in, follow-up regarding a form you submitted, and occasional market updates and promotional messages about our services.

 

How you opt in

 

You may opt in to receive text messages from us by checking the SMS consent box on a form on our website, by providing your mobile number and consent to us verbally or in writing, or by texting us first. Consent is not a condition of purchase and is not required in order to use the Services, to receive information from us, or to work with us. You can submit any form on our website without agreeing to receive text messages.

 

Message frequency

 

Message frequency varies. The number of messages you receive depends on your inquiry and on your interaction with us.

 

Costs

 

Message and data rates may apply to any message sent to you by us and to any message you send to us. We do not charge for the program itself, but your mobile carrier may charge you for messages according to your plan. If you have questions about your text or data plan, please contact your wireless provider.

 

How to opt out

 

You can opt out at any time. Reply STOP to any message you receive from us. You may also reply END, CANCEL, UNSUBSCRIBE, QUIT, or REVOKE. After you send one of these keywords, we will send a single reply confirming that you have been unsubscribed, and you will not receive further text messages from us unless you opt in again.

 

You may also opt out by emailing us at matt@mattbezci.com or by calling us at +1 212-810-6161, and we will honor that request. If you want to rejoin later, you can opt in again the same way you did the first time, or by texting START.

Carriers and delivery

 

Delivery of text messages is subject to effective transmission by your mobile carrier and is outside our control. Carriers are not liable for delayed or undelivered messages. We do not guarantee that any message will be delivered, or delivered on time.

 

Your mobile information is not shared

 

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All other categories of information described in our Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Mobile opt-in data is used only to operate this messaging program and is disclosed only to the messaging platform providers that transmit messages on our behalf under written contract, or where required by law.

 

Your responsibilities

 

You represent that you are the subscriber of, or the customary user of, the mobile number you provide, and that you are authorized to consent to receive messages at that number. If your mobile number changes or is reassigned, you agree to notify us promptly. Wireless carriers supported may change from time to time.

 

9. EMAIL COMMUNICATIONS

 

If you provide your email address, you may receive emails from us, including responses to your inquiry, information you requested, and market updates or other marketing messages. You can unsubscribe from marketing emails at any time using the unsubscribe link in any marketing email we send, or by contacting us at matt@mattbezci.com. We may still send you non-marketing messages that are necessary to respond to a request you have made.

 

10. INTELLECTUAL PROPERTY

 

Unless otherwise indicated, the Services and all content on them, including text, guides, reports, graphics, layouts, and compilations, are owned by or licensed to us and are protected by copyright, trademark, and other laws. You may view, download, and print content from the Services for your own personal, non-commercial use. You may not reproduce, republish, distribute, sell, license, scrape, data-mine, or create derivative works from the Services or their content without our prior written permission.

 

Property photographs, floor plans, and listing content may be owned by third parties and are used with permission or under license. Third-party names, logos, and marks appearing on the Services are the property of their respective owners.

 

11. PROHIBITED ACTIVITIES

 

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms

• Submit false, misleading, or fraudulent information, or impersonate any person or entity

• Submit another person's contact information or mobile number without their permission

• Use any robot, scraper, crawler, or automated means to access, harvest, or copy the Services or any data on them

• Attempt to gain unauthorized access to the Services, to any server or database we use, or to any other user's information

• Interfere with, disrupt, overload, or attempt to disable the Services

• Introduce any virus, malware, or other harmful code

• Use the Services to send unsolicited commercial messages

• Use the Services in a way that violates fair housing or anti-discrimination law

 

12. THIRD-PARTY WEBSITES AND CONTENT

 

The Services may contain links to websites, listings, tools, and content operated by third parties. We do not control and are not responsible for the content, accuracy, availability, or privacy practices of any third-party site. A link is not an endorsement. Your use of any third-party site is at your own risk and is governed by that site's own terms and privacy policy.

 

13. DISCLAIMER OF WARRANTIES

 

The Services and all content on them are provided on an "as is" and "as available" basis, without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising out of course of dealing or usage of trade.

 

We do not warrant that the Services will be uninterrupted, secure, timely, or error-free, that any defect will be corrected, or that the Services or any server we use are free of viruses or other harmful components. We do not warrant the accuracy, completeness, reliability, or currency of any content, estimate, or result made available through the Services.

 

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

 

14. LIMITATION OF LIABILITY

 

To the fullest extent permitted by law, in no event will Pina Global LLC or its members, managers, officers, employees, agents, or affiliates be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business opportunity, or goodwill, arising out of or relating to your use of or inability to use the Services, your reliance on any content or estimate provided through the Services, any transaction you enter into or decline to enter into, or any communication sent or not sent through our messaging or email programs, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.

 

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Services will not exceed one hundred United States dollars (US $100.00).

 

Nothing in these Terms limits any liability that cannot be limited under applicable law, and some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

 

15. INDEMNIFICATION

 

You agree to defend, indemnify, and hold harmless Pina Global LLC and its members, managers, officers, employees, agents, and affiliates from and against any claim, demand, loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising out of or relating to your use of the Services, your violation of these Terms, your violation of any law or the rights of any third party, or any information you submit through the Services, including any mobile number you provide that you were not authorized to provide.

 

16. TERM AND TERMINATION

 

These Terms remain in effect while you use the Services. We may modify, suspend, or discontinue the Services, or restrict or terminate your access to them, at any time and without notice, for any reason, including if we believe you have violated these Terms. The provisions of these Terms that by their nature should survive termination will survive, including Sections 10, 13, 14, 15, and 18.

 

17. CHANGES TO THESE TERMS

 

We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date at the top of this page and will be effective as soon as it is posted. Your continued use of the Services after any change means you accept the revised Terms. We encourage you to review this page periodically.

 

18. GOVERNING LAW AND DISPUTE RESOLUTION

 

These Terms and any dispute arising out of or relating to them or to the Services are governed by the laws of the State of New York, without regard to its conflict of laws principles.

 

Informal resolution first. If you have a dispute with us, you agree to contact us first at matt@mattbezci.com and to attempt in good faith to resolve it informally for at least thirty (30) days before starting any formal proceeding.

 

Venue. If a dispute is not resolved informally, you and we agree that it will be brought exclusively in the state or federal courts located in New York County, New York, and you and we consent to the personal jurisdiction of those courts. Either party may bring a qualifying claim in small claims court.

 

Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

 

Entire agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Services, and supersede any prior understanding on that subject. Our failure to enforce any provision is not a waiver of it.
